We believe that the letter dated February 4,
2000, to Attorney General of Washington, Attn.: Barbara Chambers,
from Jim Elliott, General Manager of Poulsbo RV, Everett, WA, was
designed by Elliott to prejudice our case against Poulsbo RV now
and, by attempting to damage our character in the eyes of the
state, in the future as well.
Following is a sentence-by-sentence rebuttal (sentence numbers in
parentheses) to that letter.
(1) "In regard to Mr. Ellingson's complaint, we are
currently working with legal council (sic) to address his
issues."
Legal counsel to which he
refers is Poulsbo RV's attorney, who was brought into the case
after we filed a complaint with the Attorney General of
Washington. He has written to us, not to address our issues nor
to deny that what we say is true, but solely for the purpose of
attempting to disclaim Poulsbo RV's responsibility and to try to
scare us off, and not once, in any correspondence, disputing the
fact that his client, Poulsbo RV, sold us a defective motorhome.
(2) "Mr. Ellingson has made false statements in regard to
the RCW's..."
This is a lie.
If he refers to The Revised Code of Washington, we stated nothing
in regard to it. We did refer to Federal law, and we did quote
the wrong chapter. This has nothing to do with the fact that
Poulsbo RV sold us a motorhome with hidden damages and hidden,
unrepairable defects.
(2) "...and has misrepresented the service he has received
from us."
This is a lie. We challenge general manager Jim
Elliott, general service manager Larry McAmis, or anyone else at
Poulsbo RV to show how we have done this.
(3) "I have talked to the highest levels of Fleetwood in
regard to correcting any issues he may have with his
motorhome."
We have no idea what this
statement means because Poulsbo RV has never been in contact with
us.
(4) "Both Fleetwood and Poulsbo RV have agreed to fix any
problems he may have."
This is a lie.
Nobody at Poulsbo RV, including Jim Elliott, has contacted us at
any time.
(5) "We have tried to contact Mr. Ellingson numerous times,
but he will not take the phone calls."
This is a lie. We have three separate phone numbers,
all listed, and have never been contacted by Poulsbo RV, either
by phone or by mail.
(6) "Despite what he says on his web-site, he is not willing
to talk with us or our attorney."
This is a lie. We have corresponded with Poulsbo RV's
attorney ever since the first time he contacted us, and have
responded to every letter and e-mail from him. We told him that
all communication must be in writing because of the lies
previously told to us by Poulsbo RV.
(7) "He has misrepresented and misquoted myself and my staff."
This is a lie. We have represented nothing about Jim
Elliott except that we wrote him a letter and he ignored it,
which is the truth. We have never quoted him until now. We have
published on our web site the lies that were told to us by
salesperson Cheryl Gerry and General Service Manager Larry
McAmis, as well as the lies told about us to the Washington
Attorney General by Jim Elliott.
(8) "He has been asked to remove his defamatory statements
as the (sic) pertain to personnel or he may be sued."
Jim Elliott is well aware that we have
made no defamatory statements. Neither Poulsbo RV nor its attorney has ever
defined any of our statements as untrue because the statements we have made
are true, and they know it. Jim Elliott, in his letter to the Washington Attorney
General, however, has made untrue, defamatory and libelous statements about
us.
(9) "As of this date he has not responded."
This is a lie. We have responded to all communication
from Poulsbo RV's lawyers. There has been no communication at all
from Poulsbo RV.
(10) "However, our offer to fix his motorhome still
stands."
This is a lie. Poulsbo RV has never made an offer to
us of any kind.
(11) "If you have any further questions, feel free to
contact me."
This sentence has no relevance.
The general manager of
Poulsbo RV, Everett, Washington, Jim Elliott, managed to pack eight lies into that one-paragraph letter to the
Washington Attorney General.
